Judicial Activism Part 780548.3

The 2nd U.S. Circuit Court of Appeals today struck down DOMA becoming the second court to do so in recent times.

Section 3 of DOMA was deemed unconstitutional: 
DOMA’s classification of same-sex spouses was not substantially related to an important government interest. Accordingly, we hold that Section 3 of DOMA violates equal protection and is therefore unconstitutional.
OK, let's tally up the judicial activist count on this one.

Judge Dennis Jacobs , appointed by Bush the Elder, voted YEA.
Judge Chester Straub, appointed by Slick Willy, voted NAY.
Judge Christopher F. Droney, appointed by Slick Willy, voted YEA

The question is, which one was the activist?

Maybe we should look at the other court to decide this important question.

Judge Michael Boudin, appointed by Bush the Elder, voted YEA.
Judge Juan Torruella, appointed by St. Reagan, voted YEA.
Judge Sandra Lynch, appointed by Slick Willy, voted YEA.

I can't tell whether they are activists or RINOs.

This is so confusing.
